SellHouse.com.au, herein after refer as “SellHouse”, is an online service operated by ABC Web Studio, LLC of 1220 N.Market Street, Wilmington, DE 19801, USA. SellHouse provides information services to other third parties herein after refer as "Member" through the web site www.sellhouse.com.au herein after refer as “Site”. Member means either a person or corporate entity who establishes or accesses a connection herein after as "Account" for access to and use of SellHouse.
Acceptance of Terms and Conditions
By accessing, browsing or using the information services provided by SellHouse, Member accepts the present Terms and Conditions and acknowledge reading and understanding the Terms and Conditions. SellHouse reserves the right to amend the Terms and Conditions from time to time, without prior notice with immediate effect.
Copyright and Intellectual Property

Rules of Conduct
Member must use SellHouse for lawful purposes only. Unless otherwise indicated by SellHouse in writing, Member may not:
use the information obtained from the Site for profit or commercial purpose;
post or transmit through the Site any material, which may be considered as threatening, vulgar, illegal, obscene, offensive, pornographic or otherwise objectionable;
publish false, inaccurate or misleading statements;
publish any material protected by copyright or other rights without the permission of the owner of the copyright;
transfer access to the Site to third parties;
use the Site for advertising or soliciting;
knowingly publish a content containing any virus, worm or Trojans;
create Internet links from the Site;
mirror the site;
use the Site’s facilities to send spam or bulk emails;
post the same listing more than once or allow other Members to duplicate his/her listings;
allow other person to do any abovementioned.
Member must:
comply with all applicable laws, statutes, ordinances and regulations in relation to use of the Site;
comply with the present Terms and Conditions;
provide true and accurate listing information;
bear full responsibility for updating and validating listing information;
agree to indemnify SellHouse for any losses, costs and other damages that may occur due to incontinent and/or inaccurate information, any content posted by Member and breach of the present Terms and Conditions by Member;
advertise only available property;
mark an advertised property as “Sold” (rented) within 72 hours of the sale/rent;
notify Sellhouse in writing about his/her intentions to cancel the Sellhouse's services, should the latter provided free trail services. Failure in such a notification during the trial period shall imply using the Sellhouse's listing services on a commercial basis by default.
be responsible for obtaining and maintaining the equipment needed to access the Site as well as for all charges related thereto.
Limitation of Liability
Under no circumstances will SellHouse be liable for any loss or damage, including direct, statutory, consequential, special, indirect or other loss or damage, caused by a Member's reliance on information obtained through the Site. It is the responsibility of Member to evaluate the accuracy, completeness or quality of any information, opinion, advice or other content obtained thorough the Site.
Under no circumstances will SellHouse be liable for the defamatory or illegal conduct of its members or third parties.
By accessing the Site Member accepts the risk that the emails sent from the Site may contain computer viruses and the materials and software provided by the SellHouse may be incompatible with the Member’s computer.
Disclaimer of Warranty
The services and information provided by SellHouse are on “as is” basis excluding any express or implied warranties. Neither SellHouse nor its related bodies including its directors, officers and employees, make any representation or warranty in regard to accuracy or completeness of the information contained on the Site. Members use the content of the Site at their own risk.
Indemnity
Member unconditionally agrees to defend, indemnify, and hold harmless SellHouse, its related bodies, affiliated companies, their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from Member’s use or misuse of the Site.
Furthermore, Member agrees , indemnify, and hold harmless SellHouse, its related bodies, affiliated companies, their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise in relation with the performance of the SellHouse’s duties and operations as outlined in the present Terms and Conditions.
Monitoring and Termination
SellHouse shall have the right, but not the obligation, to monitor the content of Members’ listings to determine compliance with this Terms and Conditions and to satisfy the applicable laws and regulations or authorized government request. SellHouse shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or listed on the Site. At its sole discretion and without the need of providing reasons, SellHouse may terminate Member’s access to the Site, if SellHouse have strong reasons to believe that Member breaches the present Terms and Conditions or the actions of the latter may cause legal liability to SellHouse or its members.
Third Party Content
The information contained on the Site is provided by the SellHouse’s Members in good faith and believed to be accurate. Neither SellHouse nor its affiliated bodies guarantee the accuracy or completeness of the Site’s content (see Disclaimer of Warranty).
Governing Law
The service provided by SellHouse is governed by the laws of New South Wales, Australia.
